(1.7b3) Claim ownership of or imply endorsement by Purethica when using any of our original content.

(1.7c) Exclusions: This policy does not apply to:

(1.7c1) Stock images of flowers used for aesthetic purposes; and

(1.7c2) Images of people, places, crystals and or creative images that have been sourced from paid, free or royalty-free image libraries (e.g., Unsplash, Pexels, or similar platforms), which remain subject to their respective licenses.

These excluded images are used under permitted licenses and are not owned by Purethica.

(1.7d) Prohibited Uses: Unless explicitly authorised in writing, you may not:

(1.7d1) Reuse or republish any of Purethica’s original product images, names, descriptions, or custom visuals for your own business or commercial use;

(1.7d2) Misrepresent our Content as your own;

(1.7d3) Use our trade dress or brand elements in a way that may cause confusion in destiguishing between our product & services and yours or imply endorsement.

(1.7d4) Any use of stock images which have been purchased by third party sources must have approval by these parties and Purethica is not liable for the use or distribution of these images from you or your affilliates. 

1.7e) User-Generated Content: By submitting or tagging Purethica in any content (e.g., reviews, photos, testimonials), you grant Purethica a perpetual, royalty-free, worldwide license to use and reproduce such content for marketing, social media, or promotional use, unless otherwise requested in writing.

(1.7f) Infringement and Enforcement: Purethica reserves the right to pursue legal action for unauthorised use of its intellectual property, including seeking injunctive relief and damages where appropriate.

2.2 All credit card information is always encrypted during transmission over networks using either shopify or third party payment services like paypal. Purethica does not tak any liability for any errors, interruptions, payment issues or terminations from these thirsd parties. 

2.3 You agree that by using these third party services you are agreeing to the third party websites terms and conditions.

2.4 You agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of the Service, including your access to the website or contact with us through the website, without our express written permission.

2.5 Section headings in these Terms are for convenience only and do not affect the interpretation of any provisions.

3. WARRANTY

3.1 Statutory Rights: The products supplied by Purethica are accompanied by guarantees that cannot be excluded under the Australian Consumer Law (ACL). Pursuant to the ACL, you are entitled to a replacement or refund in the event of a major failure of the goods, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not constitute a major failure (the “Warranty”).

3.2 Warranty Period: Subject to Clause 3.1, Purethica offers a warranty against defects in materials and workmanship for a period equivalent to the applicable use-by date of the product, commencing from the date of purchase (the Warranty Period”). Claims submitted outside this period may not be accepted.

 3.3 Warranty Claims Process: To make a claim under this Warranty (“Warranty Claim”), you must:

 (3.3a) Provide valid proof of purchase, photographs of products received with condition of products clearly visibly notable in these images, including the date of purchase, product name, and amount paid;

(3.3b) Submit a written notice clearly identifying the alleged defect, supported reasonable evidence; and

(3.3c) Send the claim to Purethica by email to purethica@gmail.com

3.4 Remedy: If a Warranty Claim is accepted by Purethica, we will, at our sole discretion, either repair the defective product, replace it with a new or equivalent item, or offer another remedy as required under the ACL. Such repairs or replacements will be provided at no charge for parts or labour. You acknowledge that you are solely responsible for any costs incurred in returning the product to Purethica for assessment, including postage or shipping expenses.

3.5 Sole Warranty: To the extent permitted by law, the Warranty provided under this Clause constitutes the sole and exclusive warranty granted by Purethica in relation to the products, and represents your exclusive remedy in respect of any defect in the products, in addition to any non-excludable rights you may have under the ACL or other applicable law.

3.6 Implied Warranties: All warranties, guarantees, conditions, and representations that are not expressly stated in this Warranty and that may otherwise be implied by statute, common law, trade usage or otherwise (including, but not limited to, warranties of merchantability or fitness for purpose) are, to the maximum extent permitted by law, expressly excluded or, where they cannot be excluded, are limited in duration to the Warranty Period.

3.7 Exclusions: This Warranty does not extend to:

(3.7a) Any aesthetic or cosmetic aspect of the products, including colour or packaging changes;

(3.7b) Damage resulting from misuse, improper handling, neglect, accident, unauthorised repair or modification, or use contrary to intended purpose;

(3.7c) Normal wear and tear, or defects resulting from external causes beyond Purethica’s control.

3.8 Fragrance Variation:  Due to the use of natural ingredients, including plant-based extracts and essences, fragrance profiles and strength may vary slightly from batch to batch. These variations can result from a number of factors, including seasonal and climatic changes, regional differences in plant propagation, and natural sourcing conditions.

Such differences are a normal characteristic of products derived from nature and do not indicate a fault or defect. As a result, fragrance variation is not grounds for return or refund, unless the product is otherwise deemed faulty under Australian Consumer Law.

3.9 Medical Disclaimer and Limitation of Liability Purethica's vibrational essence products are intended for general wellness and lifestyle support only. They are not therapeutic goods as defined under the Therapeutic Goods Act 1989 (Cth) and are not intended to diagnose, treat, cure, or prevent any physical or mental illness.

You acknowledge and agree that:

3.9a The products must not be used as a substitute for medical advice, diagnosis, or treatment by a qualified healthcare professional;

3.9b Purethica makes no express or implied claims regarding the effectiveness of any product for the treatment of medical or psychological conditions;

3.9c Any use of the products for therapeutic purposes is done at your own risk and outside the scope of the intended use;

3.9d Purethica disclaims all liability for any loss, injury, or damage arising from the misuse or misinterpretation of the products in a medical context.

If you have any health concerns, you should consult a qualified medical practitioner before using these products.

3.10 Change of Mind Exclusion: 

Subject to your rights under the Australian Consumer Law:

(3.10a) Purethica does not accept returns or provide refunds for change of mind once a product has been opened, used, or where the tamper-evident seal has been broken;

(3.10b) Due to the nature of our products and for hygiene and safety reasons, we cannot accept returns on items that have been unsealed, unless the product is faulty or not as described;

(3.10c) If you have changed your mind and the product remains unopened, unused, and in original condition, you may contact us to request a return, which will be assessed on a case-by-case basis. Approval is at Purethica’s sole discretion and may be subject to return shipping costs and restocking fees.

3.11 Earrings and Hygiene Policy

For hygiene and safety reasons, earrings and other pierced jewellery are non-returnable and non-refundable, unless deemed faulty under Australian Consumer Law.

We are unable to accept returns or exchanges for earrings where the packaging has been opened or the hygiene seal has been broken, regardless of whether the item has been worn.

This policy ensures the integrity, safety, and quality of our wellness products for all customers.

3.12 Non-Return Policy for Sale, Discontinued, and Clearance Stock:

Products that are:

(3.12a) Sold at a discounted price as part of a sale or promotion,

(3.12b) Listed as discontinued, final sale, or clearance, or

(3.12c) Sold as damaged, imperfect, or as-is (with defects disclosed at the time of purchase),

are not eligible for return, exchange, or refund, unless the product is faulty and the fault was not disclosed at the time of sale, in accordance with your rights under the Australian Consumer Law.

By purchasing sale or clearance stock, you acknowledge and accept that:

(3.12d) The item may show signs of wear, damage, or cosmetic imperfections (where applicable),

(3.12e) May be close to or past use by date, and

(3.12f) No change-of-mind returns, refunds, or exchanges will be accepted for such purchases.

 

4. PURCHASE OF PRODUCT AND RETURNS POLICY

4.2 Payment Methods and Terms: Payments for purchases may be processed via Visa and Mastercard through our designated Payment Services Gateway. 4.4 Returns and Refunds: Purethica may, at its sole discretion, offer a refund for returned products within 0 days of purchase, provided that the product packaging is unopened and the product remains in a resalable condition as outlined in section 3. You acknowledge that any postage or shipping costs incurred in returning the product are your responsibility

5.1 Permission to Use: Use of the Purethica logo is subject to prior written approval. Professionals seeking permission to use the logo must submit a request by emailing purethica@gmail.com Approval is granted at our sole discretion and may be revoked at any time.

5.2 Conditions of Use: Use of our logo must not imply endorsement, partnership, or formal representation of Purethica. It must be clearly understood that logo usage reflects a professional association only, and not company affiliation or agency.

The logo is the intellectual property of Purethica. All rights are reserved.

5.3 Usage Standards: Approval is conditional upon the logo being used in a manner that upholds and respects the brand identity, values, and quality standards of Purethica. We reserve the right to review and approve all intended uses and representations of the logo.

5.4 Logo Integrity: The logo must always be used in its entirety. You may not separate or alter individual elements of the logo for independent use. Distortion, modification, or partial application of the logo is not permitted under any circumstances.

8.5 Product and Essence Use Policy:  Purethica does not supply raw materials or ingredients for the purpose of third-party product formulation or manufacture. Our products, including our vibrational essences and wellness items, are protected intellectual property and are not to be reverse-engineered, imitated, or repurposed in any form without authorisation. We maintain a strict policy against the unauthorised use of our formulations and branding and will pursue all available legal remedies for infringement, including injunctive relief, damages, and costs.

8.6 Non-Availability of Single Essence Items: Purethica does not sell individual vibrational essence items separately. All essence products are provided as formulated blends or sets, and individual essences are not available for standalone purchase.

8.7 Non-Disclosure of Vibrational Essence Formulations: Purethica expressly reserves the right to withhold disclosure of the specific formulations and compositions of its vibrational essences. Such proprietary information is considered confidential and trade secret material. This policy is in place to protect against unauthorized copying or reproduction of the formulations. Furthermore, as Purethica’s vibrational essences are non-toxic and have no known negative effects on users, general product labeling in compliance with applicable Australian labeling laws is deemed sufficient, and detailed ingredient disclosure is not required. The list of all flowers and crystal essences we use from Australia and the pacific islands can be found on our website in the about section.

8.8 Product Range and Formulation Discretion: Purethica offers an extensive range of over 300 crystal and flower essences, not all of which are not all listed or described on the Website. These essences may be used individually or in combination within product formulations at Purethica’s sole discretion. Purethica reserves the right to modify, substitute, or update formulations without prior notice or obligation to disclose such changes or the specific essences used in any given product.

8.9 Restrictions on Repurposing and Resale: You agree not to repurpose, repackage, or resell any of Purethica’s products or formulations unless you are an authorised wholesaler who must sell under our beand. Any unauthorised repurposing, resale, or distribution of Purethica’s products or formulations is strictly prohibited and may result in legal action.

8.10 Practitioner Use: Licensed practitioners and professionals are permitted to use Purethica’s product range with their clients, provided that such use complies fully with these Terms and Conditions, including but not limited to proper product handling, distribution, and adherence to all relevant legal and ethical standards. 13.2 You expressly acknowledge and agree that Purethica, its directors, officers, employees, agents, affiliates, licensors, and third-party service providers shall not be liable to you for any indirect, incidental, special, consequential, or exemplary damages, including without limitation:

(13.2a) loss of profit,

(13.2b) loss of goodwill or business reputation,

(13.2c) loss of data,

(13.2d) or any other intangible losses arising from your use of, or inability to use, the Website, Services, or any products provided.

13.3 Purethica shall not be held liable for any content posted on the Website by users or third parties, including errors, inaccuracies, or omissions. You agree that you use such content and services at your own discretion and risk.

13.4 Purethica does not directly provide delivery or shipping services. You acknowledge and agree that any issues related to shipping, including delays, damage, or loss, are the responsibility of the third-party delivery provider, and Purethica shall not be liable for any related direct or consequential loss


14. TERMINATION

14.1 These Terms remain in effect unless and until terminated by either you or Purethica, as outlined below.

14.2 You may terminate this agreement at any time by:
(14.2a) providing written notice to Purethica; and
(14.2b) closing your account for the Purchase Services (if such functionality is available). Notice should be submitted via the “Contact Us” page on the Website.

14.3 Purethica may terminate or suspend your access to the Website or Services at any time, without notice, if:
(14.3a) you breach any provision of these Terms, or we reasonably believe you are about to do so;
(14.3b) we are required to do so by law;
(14.3c) a third-party provider or partner discontinues their relationship with us or ceases to make services available to us;

16 DELIVERY

16.1 You acknowledge that the Purchase Services offered by Purethica may involve delivery services (the "Delivery Services") provided through third-party logistics providers ("Delivery Service Providers"). By placing an order, you agree that Purethica is not directly responsible for the operation or performance of these third-party services.

16.2 While Purethica facilitates access to various delivery and, where applicable, insurance options through these Delivery Service Providers, all delivery timeframes, shipping rates, and insurance terms are set by the Delivery Service Providers and are subject to change. Purethica makes no guarantees as to delivery timelines, costs, or outcomes, and accepts no liability for any delays, loss, or damage caused during transit.

16.3 In the event of any delivery issues, including products lost or damaged in transit, you agree to:

(16.3a) contact the relevant Delivery Service Provider directly to initiate a claim under any applicable shipping or insurance coverage you may have selected at checkout; and

(16.3b) notify Purethica by emailing purethica@gmail.com, providing full details of the issue (including photos where relevant), so that we may assess the situation and, if appropriate, reconsider our relationship with the Delivery Service Provider in question.

16.4 All risk in the Products passes to you upon dispatch. If you choose to decline insurance, you acknowledge that Purethica shall bear no liability for any loss or damage incurred after the Products leave our facility.

16.5 Purethica does not accept liability for delivery to incorrect or incomplete addresses provided by the customer. It is your responsibility to ensure all delivery details entered at checkout are accurate and complete.

16.6 In cases where a package is returned to Purethica due to incorrect address, failure to collect, or other reasons outside of our control, you may be liable for re-delivery charges.

19 DISPUTE RESOLUTION

19.1. Compulsory Process:
Subject to clause 18.6, if a dispute arises in connection with these Terms of Service or the use of any products or services provided by Purethica (the Dispute), neither party may commence legal proceedings (except urgent interlocutory relief) in any court or tribunal unless they have first complied with the procedures outlined in this section.

19.2. Notice of Dispute:
A party claiming that a Dispute has arisen must provide written notice to the other party specifying:

(19.2a) The nature and details of the Dispute,

(19.2b) The outcome sought, and

(19.2c) The action required to resolve the Dispute.

19.3. Negotiation and Mediation:
Upon receipt of a Dispute Notice:

(19.3a) The parties must attempt in good faith to resolve the Dispute by negotiation within 7 days;

(19.3b) If the Dispute is not resolved within 7 days, the parties must agree on the appointment of a mediator. If they cannot agree, a mediator shall be appointed by the President of the Australian Mediation Association (AMA) or their nominee;

(19.3c) The costs of mediation (including mediator fees and venue expenses) shall be shared equally by the parties. Each party must bear their own legal and preparation costs;

(19.3d) Mediation shall be conducted in Sydney, New South Wales, Australia.

19.4. Confidentiality:
All negotiations, communications and documentation in the course of dispute resolution are confidential and must be treated as “without prejudice” under applicable rules of evidence.

19.5. Termination of Mediation:
If the Dispute has not been resolved within 7 days after the mediation commences, either party may request the mediator to terminate the mediation process, and the mediator must do so.

19.6. Exception – Urgent Relief:
Nothing in this section prevents a party from seeking urgent interlocutory relief from a court of competent jurisdiction, if such action is reasonably necessary to protect that party’s rights.

 

20 GOVERNING LAW

These Terms of Service, and any separate agreements whereby we provide you with products or services, shall be governed by and construed in accordance with the laws of the Commonwealth of Australia.
